With Home Cooking, you can share meals once, occasionally or regularly with your neighbors. Before you want to use Home Cooked, read the conditions below carefully. These terms and conditions were last modified on 09/22/2020.

Who is Home Cooking?

Applicability

Home Cooked Account
To actively participate in the services of Home Cooked you must register by creating an account ("Home Cooked Account"). You must follow the steps indicated on the website, and truthfully fill in the requested information. In principle, only private persons can create a Home Cooked Account. In case of any changes to your details, you must update your Home Cooked Account as soon as possible. You are responsible and liable for your Home Cooked Account and the use thereof. Your Home Cooked Account is exclusively for your personal use to make arrangements about preparing, sharing and / or collecting meals for yourself or a vulnerable collector. You may not make your account available to other persons. You must protect your account with a strong password and handle this password with care. You must also ensure a secure computer / telephone (connection). If you suspect that your Home Cooked Account is being used by others, please notify us by e-mail. When using Home Cooking and preparing, sharing and / or taking out meals, you must obey the law and normal decency standards.

Manners
The most important factor for the success of Home Cooking is that users treat each other in a friendly and respectful manner. We expect users to adopt decent manners. Communicate clearly and in a timely manner about your expectations. Treat each other with respect, even when things don't turn out as you expected. Try to understand the other person's point of view and expectations and resolve problems calmly and gently.

Rules for hygiene
Every user who prepares a meal in the context of one of the Home Cooking services must adhere to the hygiene rules as drawn up in consultation with the Dutch Food and Consumer Product Safety Authority.

Rules about the use of the website
It is not permitted to approach persons who, as a home cook or customer, use the website www.thuisgekaporized.nl for purposes other than for the services of Thuisgekilderd. Home Cooking believes in the power of sharing and hopes the recepts on the website are shared as much as possible so that everyone can benefit from them. If you want to take over entire parts of the website, we ask you to contact us first via info@thuisgekapor.nl. By placing content on the website Thuisgek boiled.nl, you give us a perpetual license to use this user-generated content in the context of the function of Thuisgehapor. You guarantee that this content does not infringe the (intellectual) property rights of third parties. You indemnify Home Cooked against claims from third parties who claim that your user generated content infringes their (intellectual) property rights or other rights. Duration of the User Agreement and termination
The User Agreement is valid for an indefinite period and can be terminated by you at any time. You do this by indicating on My Home Cooked that you want to change your profile. You will then find the option to cancel my account on this page. If at the time of the termination of the User Agreement you are still a party to an agreement with one or more Users (for example, a Collection Agreement), you still have to process this agreement (s). Home Cooked can terminate a User Agreement with immediate effect if the rules are not followed or if we stop our business operations. After termination of the User Agreement, these General Terms and Conditions remain applicable to any use that you make of the website and any (financial) settlement of the agreements concluded with Users via Home Cooked.

Liability
The website www.thuisgekapor.nl has been compiled with the greatest care. However, we cannot guarantee that the website or the services of Thuisgek World will always be available and that the information provided is complete, correct or up-to-date. We also cannot guarantee that the services of Home Cooked or the actions of the other Users will meet your expectations. Insofar as permitted by law, we exclude liability for (the correctness of) information and other materials or expressions that Users or third parties place or provide on the website or via the services of Thuisgekocht (such as photos and recipes). We reserve the right to remove (unannounced) content from the website www.thuisgekapor.nl. Entering into and executing an agreement with other Users is at the User's own expense and risk. We are not a party to these agreements. To the extent permitted by law, we are therefore not liable for any damage as a result of non-compliance or incorrect compliance with the Collection Agreement or any other act or omission of Users. Home Cooked is responsible for the consequences of stopping and reclaiming direct debit payments. Any disputes about the User Agreement and these Terms and Conditions will be submitted to the court that has jurisdiction under Dutch law.

SPECIFIC SECTION- HOME COOKED AS A PLATFORM FOR COLLECTORS AND COOKES

Introduction
This part of Home Cooking is an online platform that brings together "Takers" and "Cooks", through which Cooks can offer meals to Takers. When you agree with another User via Home Cooked to prepare, share and / or collect a meal, a Takeout Transfer is made between you and that other User directly. agreement. The Takeaway Agreement includes the agreements that the Cook and the Pickup Person make with each other via Home Cooked, and supervises, among other things, the price of the meal, the method of payment and the collection time. In principle, this is indicated by the cook when offering a meal. The Collection Agreement is concluded at the moment that a Pick-up Person indicates that he wishes to collect a meal offered by a Cook via the "Take-away meal" option. We are not a party to the Collection Agreement.

Payment
Cooks charge a fee to the Collector for each meal. That price is automatically increased by 10% on the website. The fee will be withheld if the person who collects it pays online for his meal. If the owed Commission cannot be collected by means of the online payment, we will give the relevant Chef the opportunity to pay us the amount due within 14 days. If the amount due is not received within that period, we will close the Home Cooked Account of the relevant Cook. We will charge any costs we have incurred or have to incur in this regard to the relevant Cook. Possible disputes between Users about the price of a meal do not preclude the payment of the fee to Home Cooked.

Payments and cancellations (single meals)
Collectors pay the total cost of their meal prior to collecting a meal via the website via iDeal, Bancontact and the U-Pas. This amount consists of the meal price determined by the home cook plus the Home Cooked Committee. Possible disputes between collectors and home cooks about the price of the meal do not affect the commission owed to Thuiskokook. Pick-ups cannot cancel individual meals after payment.

Payments and cancellations (subscriptions)
Collectors can cancel the agreement that has been entered into and concerns that a "regular home cook" cooks for the collector a fixed number of times per week via a subscription, at all times, taking the following into account. If the subscription is canceled 2 weekday (Mon-Fri) days before the cooking moment, you will no longer receive a meal. You can cancel the "regular home cooking service" or subscription service via your dashboard or via customer service or email. Home chefs can cancel meals by notifying them in their account no later than 24 hours prior to the time the meal would be collected, after which the collector will be informed.

Payment method; direct debit (for subscriptions) The deposit can be paid via iDeal. If you choose to pay via iDeal in the ordering process, the amount of the deposit will be debited directly from your account. In addition, you give permission to Multisafepay (acting for Home Cooking) to send continuous SEPA direct debit orders to your bank to debit an amount from your account. It is your responsibility to ensure that the details of your payment method are valid and up to date. It is your responsibility to ensure that you have sufficient funds at the time of payment. If you do not agree with a SEPA direct debit as referred to under §6 (1), you can have it refunded under the conditions agreed between you and your bank. Please contact your bank for this within eight (8) weeks after the debit. Ask your bank for the conditions. If a payment order cannot be executed due to insufficient funds, incorrect or outdated payment details and / or other disputes, meals can still proceed. In such cases, Thuisgekook will initiate the collection again. We reserve the right to reclaim the outstanding amount by re-making the payment through the specified payment method. If the attempts to make the payment again are unsuccessful, Thuisgekook.nl has the right to set off the debt against the deposit paid at the start of the subscription period. The takeaway acknowledges and agrees that although Thuisgekoked is not a party between the collector and the home cook, Thuisgekapor accepts payments on behalf of the home cook. If your payment has been added to the Home Cook credit, the obligation to pay the home cook has been met. Home cooked is then responsible for paying out the amount stated in the terms and conditions.

In this particular case, however, it is about to those who are (temporarily) in a vulnerable position, and are therefore asked to do something extra from the Cook. When a match between a Collector and a Cook is made via this section and the Cook accepts it, a Collection Agreement is concluded between the Collector and the Cook. The Take-Out Agreement includes the agreements that the Cook and the Pick-up Person make with each other via Thuiskokook. The Collection Agreement regulates, among other things, the price of the meal, the method of payment and the special agreements that are made in the context of the vulnerability, such as the frequency of cooking, the method of delivery or collection and any other agreements in the framework of social contact. These agreements are made jointly by the Collector and the Cook, possibly with the help of the “Intermediary” who has registered the Collector. This Intermediary and Home Cooked are not party to the Collection Agreement.

How do you use the Cook service for extra help?
For every Cook who has registered with Home Cooking, there is the option to indicate that he / she is also available for the "Cook for extra help" service. Registering a Pick-up can be done in various ways, both by the Pick-up and by the Intermediary. Contrary to the normal Home Cooking, someone from Home Cooking looks at "Kok for extra help" every registration and checks whether they qualify for "Cook for extra help". If necessary, Home Cook can ask for additional information or give tips on recruiting Chefs. If the Pick-Up Person does not select a Chef from the website afterwards, Thuiskok can do so. We ask the Collector and any Intermediary themselves to check whether this match indeed meets expectations.

Payment
The Pick-up Person will have given an indication of his maximum budget per meal with the request. In consultation with the cook, final agreements are made about price per meal and method of payment. Home cooking is not involved in the payments.

Payout Information

Home-cooked is not responsible for any loss as a result of you not or incorrectly entering payout information. Every Home Cooked Home Cook who requests payments for meals offered through Home Cooked, appoints Home Cooked as the collector, solely for the purpose of accepting payments from collectors and paying them to home cooks. Every Home Cooked Home Cook agrees that the payment made via Thuisgekijnt.nl will be treated in the same way as a payment made directly to the home cook. The home cook must deliver the purchased meals to the collector in the agreed manner and in the same way as he / she received the payment directly from the collector. Every home cook understands that a successful receipt of the payment by the collector is a prerequisite for making the payment to the home cook. Home Cooked can only guarantee payouts to home cooks for the amounts successfully received from collectors. Payouts to home cooks are made weekly on Thursdays from a minimum payout amount of € 20.
